Q: 1) How much deposit is required to book the apartment, and what are the cancellation charges.

A: To book the apartment we would require a deposit of £50 with the balance due eight weeks beforehand. If this is not received in time, we reserve the right to cancel your booking. Cancellation charges then rise accordingly. Please ask for details. There would be a 1.5% credit card charge on balances only.

 

Q: 2) Can Holiday Apartments Abroad cancel my booking?

A: We reserve the right to cancel your apartment at any time but will only do so prior to the balance due date. We will only do so after that date if in our opinion it is necessary/ advisable because of circumstances amounting to Force Majeure. In which case we will offer a choice of another apartment of at least comparable standard, if available, or a full refund of all monies paid in relation to the apartment. If Holiday Apartments Abroad have not heard within seven days, they will assume you wish to cancel and issue a refund.

 

Q: 3) Can Holiday Apartments Abroad change my booking?

A: Occasionally Holiday Apartments Abroad may have to make a material change to your apartment. In such cases you will be offered an apartment of at least comparable standard, if available, or a full refund of all monies paid in relation to the apartment. The above seven day rule will apply. The acceptance of the Material change or refund, together with any compensation to which you may be entitled (ask for details) will be your sole remedy against Holiday Apartments Abroad. Holiday Apartments Abroad accept no liability for any sum or any other compensation. This includes and amendment charges incurred if you book your flights independently. (This would not apply if you booked the flights through ourselves). No compensation will be due when a change is due to Force Majeur.

 

Q: 4) Can the price of my apartment increase?

A: Should the Government or any other body, be it in England, Spain or the Canaries increase the level of tax, duty, etc. Holiday Apartments Abroad will absorb the increase up to 10% of the cost of the booking. If the increase is more than 10%, then we reserve the right to pass this increase on. Alternatively you would be entitled to cancel free of charge within 14 days of notification. Holiday Apartments Abroad would not be liable for any additional compensation nor will be held liable for any additional costs you may incur.

 

Q: 5) What is the situation if I have to cancel my booking?

A: All cancellations must be made in writing and posted to our address in Shrewsbury. We regret to say that we cannot accept cancellation requests by phone or e-mail, unless in exceptional circumstances. We advise that all letters are sent recorded delivery, as we cannot be held responsible if letters get lost in the post.

 

Q: 6) What is the situation if I have to change my booking?

A: Holiday Apartments Abroad are under no obligation to accept any change, although we will try our best to help. Any change incurs a £30 fee, plus any charges we may incur from our suppliers. Any late changes could incur cancellation fees. (Ask for details). If you change the number of people, the apartment price will be recalculated accordingly. Any changes made on holiday are subject to availability and any extra cost being paid.

 

Q: 7) What are Holiday Apartments Abroad obligations?

A: Please be aware that these include limitations on the liability of Holiday Apartments Abroad & its obligations relating to any holiday and certain exclusions of responsibility. These conditions do not govern your rights and / or duties in relation to any other person or company whose services may be used on any holiday. Full details can be found in the complete booking conditions. A copy can be supplied on request.

 

Q: 8) What our your responsibilities?

A: When you book a holiday with Holiday Apartments Abroad you accept responsibility for the proper conduct for yourself and your party, whilst on holiday. Holiday Apartments Abroad reserve the right to terminate your holiday or that of any member of your party due to misconduct and to have no further responsibility or liability to you. If your actions or those of any other member of your party cause damage to any accommodation, or cause delay / diversion to any flight or other means of transportation. You agree to fully indemnify Holiday Apartments Abroad against any claim including legal costs made against them or any other operator.

Q: 9) And Finally ...

A: All apartment & complex descriptions are made in good faith and every care is taken to ensure their accuracy. However advertised facilities, amenities, entertainment & schedules may on occasion be restricted, curtailed, changed or cancelled without notice. Holiday Apartments Abroad will not be liable for any such circumstances beyond its control nor shall any such event give rise to any refund or other claim whatsoever against them.

This contract is subject to English law, and by booking you agree to submit any dispute or claim to the English courts unless otherwise agreed.
